1. About these Terms

1.1 These Terms and Conditions govern membership of the Plume Perks or Plume Loyalty Club (the Program), operated by The LifeGrain Group LifeGrain Pty Ltd ABN 23 648 844 375, trading as Plume Cafe (Plume, we, us, our).

1.2 By joining the Program, using a Member account, scanning your Member code, ordering through the Plume app, or accepting any Program benefit — including the Hospital Staff Discount — you accept these Terms.

1.3 These Terms should be read together with the Plume privacy policy and any terms applying to the Plume app or the platform on which the Program is operated. If there is any inconsistency, these Terms prevail in relation to the Program itself.

1.4 The Plume Loyalty Club and the LifeGrain Loyalty Club are separate programs operated by the same group. Points, Rewards, membership status and Hospital Staff Discount verification are not shared, transferred or combined between them. A Member of one program is not automatically a Member of the other.

1.5 The current version of these Terms is published at plumecafe.com.au/perks. The version in force at the time of a transaction applies to that transaction.

1.6 These Terms do not create an employment entitlement, a workplace benefit, or any contractual right against any hospital, health service, local health district, university or site operator. The Program is offered by Plume alone.

2. Definitions

Term

Meaning

Member

An individual who has joined the Program and holds a current, active Member account.

Member Account

The account created on the Plume loyalty platform in the Member’s name, accessed through the Plume app or Member code.

Points

The units credited to a Member Account for Qualifying Purchases, as set out in Schedule 2.

Qualifying Purchase

A purchase of eligible goods at a Participating Store, made by a Member, where the Member Account is identified before the transaction is completed, and which is not excluded under clause 5.5.

Reward

Any benefit made available to a Member, including members-only offers, vouchers, free items, trials, Surprise Drops, Prize Draw entries and discounts.

Surprise Drop

An unannounced Reward or offer issued by Plume at its discretion to some or all Members, as described in clause 7.

Prize Draw

A raffle, draw or game of chance run by Plume for Members, as described in clause 8.

Membership Level

The recognition level allocated to a Member based on activity, as described in clause 6 and Schedule 2.

Participating Store

A Plume Cafe site listed in Schedule 1, as updated from time to time.

Hospital Staff Discount

The discount described in clause 10, available only to Verified Members.

Participating Site Organisation

A hospital, health service, local health district, university or campus operator listed in Schedule 3 at whose site a Participating Store operates.

Verified Staff Member

A Member whose eligibility for the Hospital Staff Discount has been registered and verified by Plume under clause 10.

App Order

An order placed and paid for in advance through the Plume app for collection at a Participating Store, as described in clause 12.

Program Platform

The loyalty and ordering platform used by Plume to administer the Program, including the Plume app.

3. Eligibility to join

3.1 Membership is open to individuals aged 16 years or over who hold a valid mobile number and email address and can access a Participating Store.

3.2 Members aged under 18 must have the consent of a parent or guardian to join and to receive Program communications. Plume does not knowingly create Member Accounts for individuals aged under 16. Members under 18 are not eligible to enter a Prize Draw where clause 8.4 says otherwise.

3.3 Membership is personal to the Member. Businesses, departments, wards, teams, buying groups and automated systems may not hold a Member Account.

3.4 One Member Account per person. Where Plume identifies duplicate accounts held by the same individual, we may merge or close the duplicates and consolidate the Points balance.

3.5 Membership is free. No purchase is required to join.

4. Joining and your Member Account

4.1 You can join by downloading the Plume app from the Apple App Store or Google Play, or by registering in store with the assistance of a team member.

4.2 You must provide accurate, current and complete information when joining, and keep your details up to date. Plume is not responsible for Rewards, Surprise Drops, Prize Draw notifications or other communications that are not received because your contact details are out of date.

4.3 You are responsible for keeping your account credentials secure. Tell us promptly if you believe your Member Account has been accessed without your authorisation.

4.4 Member Accounts, Points and Rewards have no cash value, are not property, are not transferable, cannot be sold, exchanged, gifted or pooled and do not form part of a deceased estate.

5. Earning Points

5.1 Points are earned on Qualifying Purchases at the rate set out in Schedule 2.

5.2 You must identify your Member Account before the transaction is completed — by scanning your Member code at the counter, or by ordering through the app. App Orders placed through a logged-in Member Account identify your account automatically.

5.3 Points cannot be credited retrospectively. If you do not scan or identify your Member Account before payment is processed, no Points are earned for that transaction. Receipts presented afterwards will not be honoured, except where a Points allocation has failed because of a technical fault on our side and you contact us within 14 days.

5.4 Points are credited to the Member Account, not to the payment method, the device or the person collecting the order.

5.5 Points are not earned on: gift card purchases; catering and function orders, including orders placed through the Plume catering service; purchases made through third-party delivery or ordering platforms; account-billed and corporate transactions; charges that are not for goods, such as surcharges and fees; refunded or cancelled transactions; and any other categories listed in Schedule 2.

5.6 Where a transaction is refunded in whole or in part, the associated Points are reversed. If a Reward has already been redeemed against reversed Points, Plume may adjust the Member Account balance accordingly.

5.7 Points balances shown in the app are indicative and may take up to 48 hours to reflect recent activity. Where there is a discrepancy, Plume’s transaction records prevail, subject to clause 21.

6. Membership Levels

6.1 The Program recognises Members at the levels set out in Schedule 2. Level allocation is automatic and is based on Member purchase activity over the assessment period stated in Schedule 2.

6.2 Membership Levels are assessed by the Program Platform without individual review. Levels may go down as well as up. If your activity falls below the threshold for your level over the assessment period, you will move to the level that matches your activity, and the benefits of the higher level will no longer apply.

6.3 Where Plume promotes that benefits improve with frequency of visit, the thresholds and benefits that apply are those published in Schedule 2 at the relevant time. No benefit is promised beyond those published.

6.4 Plume may change level thresholds and level benefits under clause 15. Where a change reduces the benefits of a level you currently hold, we will give at least 30 days’ notice before it takes effect.

7. Rewards, members-only offers and Surprise Drops

7.1 Rewards are shown in the Plume app and must be presented at the counter at a Participating Store at the time of the transaction.

7.2 Rewards are subject to availability, are limited to one per transaction unless stated otherwise, cannot be redeemed for cash, cannot be part-redeemed, and cannot be reinstated once redeemed or expired.

7.3 Where a Reward is for a specific item, substitutions are at the discretion of the Participating Store. Where a Member selects an item of higher value, the difference must be paid.

7.4 Birthday Rewards are issued once per Member per year and require a verified date of birth recorded at least [7] days before the birthday.

7.5 Surprise Drops, free trials, members-only extras and similar benefits are issued at Plume’s discretion. They are not earned, not guaranteed, not an entitlement of any Membership Level, and may be offered to some Members and not others, including on the basis of store, purchase history or timing. No Member has a right to receive a Surprise Drop, and a Surprise Drop received once does not create an expectation of another.

7.6 Each Reward states its validity period at the time it is issued. Rewards not redeemed within that period expire and are not reissued.

7.7 Rewards may not be used in conjunction with any other offer, discount or promotion unless expressly stated. See clause 11.

8. Prize Draws and raffles

8.1 Plume may run Prize Draws for Members. Each Prize Draw is governed by these Terms and by the specific conditions published for that Prize Draw. Where the two are inconsistent, the specific conditions prevail for that draw.

8.2 The specific conditions for each Prize Draw will state, at a minimum: who may enter; how to enter and whether a purchase is required; the entry period, including opening and closing times; the total number and retail value of prizes; how and when the draw will be conducted; how the winner will be notified; and how unclaimed prizes will be dealt with. These conditions will be available before entries open.

8.3 Prize Draws are conducted in New South Wales and are subject to the Community Gaming Act 2018 (NSW) and the Community Gaming Regulation 2020 (NSW). Where a Prize Draw is promoted or open to residents outside New South Wales, the requirements of the relevant state or territory also apply and will be reflected in the specific conditions for that draw.

8.4 Unless the specific conditions say otherwise, entrants must be Members, be aged 18 years or over, and be residents of New South Wales. Employees of The LifeGrain Group and their immediate families are not eligible to enter.

8.5 Prizes are not transferable and not exchangeable for cash. Where a prize becomes unavailable for reasons outside Plume’s control, Plume may substitute a prize of equal or greater retail value, subject to any approval required by law.

8.6 Winners will be notified using the contact details held on the Member Account. If a winner cannot be contacted, or does not claim the prize within the period stated in the specific conditions, the prize may be redrawn or forfeited in accordance with those conditions.

8.7 Plume’s decision in relation to a Prize Draw is final, subject to clause 21 and to any right the entrant has under law.

8.8 Entry into a Prize Draw may involve the collection and use of personal information, and winners’ names may be published where the specific conditions and clause 17 permit. Entrants who do not wish their name to be published should not enter.

9. Inactivity and expiry of Points

9.1 Points remain valid while the Member Account is active. A Member Account is active if the Member makes at least one Qualifying Purchase in any 12-month period.

9.2 If no Qualifying Purchase is made for 12 consecutive months, the Member Account is treated as inactive and accrued Points expire.

9.3 Before Points expire, Plume will send at least one reminder to the Member’s registered email address or app inbox no fewer than 30 days before the expiry date. If the Member’s contact details are out of date, the reminder is still taken to have been given.

9.4 Expired Points cannot be reinstated, other than where they expired because of an error by Plume.

10. Member Discount

The Member Discount is part of the Plume Loyalty Club. It is available to any Member who completes discount registration. Registration is open — you do not need to work at a hospital or campus site to receive it.

10A. What the discount is

10.1    The Member Discount is a discount of up to [10]% on eligible purchases at Participating Stores, applied at the point of sale to Registered Discount Members. In some Plume materials this discount is promoted as the Hospital and Campus Staff Discount.

10.2    The discount is delivered exclusively through the Program. It is available only to Members who have completed registration under clause 10.8. It cannot be applied on request at the counter, on presentation of a staff identification card alone, or retrospectively.

10.3    The discount rate is up to [10]%. Some items and categories attract a lower rate or no discount at all. The rate that applies to each category, and the lines that are excluded, are set out in Schedule 3. The discounted price is shown at the point of sale before payment.

10.4    Registration for the Plume Loyalty Club Member Discount is separate from the equivalent discount in the LifeGrain Loyalty Club. A Member registered in one program must register separately in the other.

10B. Who can register

10.5    Registration is open to any Member who meets the eligibility requirements for membership in clause 3. There is no employment, occupation or site requirement.

10.6    Plume does not require you to hold, produce or provide a hospital, health service, university or campus identification card, an employee number, a work email address or any evidence of employment in order to register for or receive the Member Discount. Store teams are instructed not to request or accept these documents.

10.7    Where the Member Discount is promoted to workers at the hospital and campus sites where Plume operates, that reflects who we expect will use it most. It does not limit who may register. The discount is offered by Plume as its own commercial gesture. It is not provided by, funded by, negotiated with, or endorsed by any hospital, health service, local health district, university or site operator, and it does not form part of any employment agreement, enterprise agreement, award or staff entitlement.

10C. How to register

10.8    To register, join the Plume Loyalty Club and complete Member Discount registration in the Plume app, providing your name, mobile number, email address and your usual Plume store. No further information is required.

10.9    Plume does not collect, request or hold information about your employer, role, occupation, clinical specialty, professional registration, health information or employment terms in connection with the Member Discount. You should not provide payslips, contracts, rosters, identification cards or clinical credentials.

10.10  The discount is ordinarily available on your Member Account within [insert period] of registration. Registration is confirmed in the app.

10D. How to use the discount

10.11  You must identify your Member Account before the transaction is completed. The discount is applied automatically at the point of sale to eligible items. It cannot be applied after payment, and no adjustment or refund is made for transactions where the Member Account was not identified.

10.12  The discount is for your own personal consumption only. It may not be used for:

—  resale, redistribution or any commercial purpose;

—  ward, department, team, meeting or group orders, unless approved in writing by Plume;

—  catering and function orders; or

—  use by any person other than the Registered Discount Member.

10.13  Your Member Account, app login and Member code must not be shared, lent or transferred to any other person.

10.14  The discount is limited to one discount per transaction per person, as stated in Schedule 3.

10E. Exclusions and interaction with other offers

10.15  The Member Discount does not apply to: items already discounted or on promotion; combo, bundle and meal-deal pricing; catering, functions and group platters; gift cards; account-billed and corporate transactions; purchases made through third-party delivery or ordering platforms; and any other lines listed in Schedule 3.

10.16  The Member Discount cannot be combined with any other percentage discount, voucher, Reward, Surprise Drop or promotional offer, unless expressly stated in Schedule 3.

10F. Suspension, withdrawal and variation

10.17  Plume may suspend or withdraw the Member Discount from a Member, without notice, where we reasonably believe that the discount has been shared or transferred, that false or misleading information was given at registration, or that the discount has been used in a way that breaches clause 10.12.

10.18  Where the discount is withdrawn for misuse, Plume may also close the Member Account under clause 14 and may recover the value of discounts obtained improperly.

10.19  Plume may vary the discount rate, the categories to which it applies, the exclusions or the discount mechanic, or withdraw the Member Discount entirely, on 30 days’ notice given under clause 15. Where a site operator requires a change, or where a store ceases to trade at a site, the change may take effect on shorter notice and we will tell affected Members as soon as we reasonably can.

11. Combining offers

11.1 Unless expressly stated, only one discount, voucher, Reward, Surprise Drop or promotional offer may be applied to a transaction.

11.2 Where more than one benefit could apply, the point-of-sale system applies the single benefit of greatest value to the Member, and no further benefit is applied to that transaction.

11.3 The keep cup discount and other always-on sustainability incentivesmay be combined with the Hospital Staff Discount, as stated in Schedule 3.

12. Ordering ahead through the Plume app

This clause applies at Participating Stores where the App Order function is enabled, as marked in Schedule 1.

12A. Placing an App Order

12.1 Members may order and pay in advance through the Plume app for collection at a Participating Store. App Orders are available only at enabled stores and only during that store’s trading hours.

12.2 An App Order is accepted when the store confirms it in the app. Until then, no contract for the supply of those items is formed.

12.3 Payment is processed when the App Order is placed, through the payment provider integrated with the app. Plume does not store your full card details.

12B. App pricing

12.4 Some items may be offered at a lower price through the app than the price displayed in store. App pricing is set by Plume, applies only to items purchased through an App Order, and may be varied or withdrawn at any time.

12.5 The price shown at checkout is the total amount payable for the App Order, inclusive of GST and of any service, transaction or packaging charge that applies. Any such charge is disclosed before you confirm payment.

12.6 App pricing is not a Reward and is not part of your Membership Level benefits. It is available to any Member using the app at an enabled store.

12C. Points on App Orders

12.7 App Orders are Qualifying Purchases. Points are earned at the rate in Schedule 2, calculated on the amount actually paid after app pricing is applied, provided the App Order is placed through a logged-in Member Account.

12.8 Points for an App Order are credited when the order is paid. If the order is cancelled or refunded, the Points are reversed under clause 5.6.

12D. App pricing and the Hospital Staff Discount

12.9 App pricing is discounted pricing for the purposes of clause 10.17.

12.10 Where a Verified Staff Member could receive either app pricing or the Hospital Staff Discount on the same item, only one applies. Clause 11.2 governs which benefit is applied.

12E. Collection, changes and cancellation

12.11 The collection time shown in the app is an estimate. Collection may be delayed at peak periods, and Plume is not liable for loss arising from a delayed collection time, subject to clause 19.

12.12 Orders are held for collection for up to one hour from the time they are ready. For food safety reasons, orders not collected within that period may be disposed of. Where the order was not collected for a reason within your control, a refund is not available, except where required by law.

12.13 Once an App Order has been accepted and preparation has begun, it cannot be cancelled or amended through the app. Contact the store as soon as possible if you need to change or cancel an order. Refunds are processed to the original payment method.

12.14 Where an item is unavailable after an App Order is accepted, the store will contact you to agree a substitution or will refund the price of that item.

12F. Product information, allergens and site access

12.15 Product descriptions and images in the app are a guide. Our stores prepare food in kitchens that handle allergens, including nuts, gluten, dairy, egg, soy, sesame and seafood, and we cannot guarantee that any item is free from a given allergen. If you have a food allergy or intolerance, speak to the store before ordering rather than relying on the app.

12.16 App Orders depend on access to the store. Where a site imposes access restrictions, closes a precinct, or where a store closes at short notice, App Orders may be suspended or cancelled. Affected orders are refunded in full.

13. The app, the platform and availability

13.1 The Program is administered through the Program Platform and, in part, through the Plume app. Access to the app requires a compatible device, an internet connection and acceptance of the app store terms, which are not controlled by Plume.

13.2 Plume does not warrant that the app or Program Platform will be uninterrupted or error free. Where a technical fault prevents Points from being credited or a Reward or discount from being applied, contact us under clause 23 within 14 days and we will correct the Member Account where our records support the claim.

13.3 Where the Program Platform is unavailable at the point of sale, store teams may not be able to apply Rewards or the Hospital Staff Discount. The transaction proceeds at the standard price and the benefit is not applied retrospectively, except under clause 13.2.

14. Misuse, suspension and closure

14.1 Plume may suspend or close a Member Account, cancel accrued Points and cancel unredeemed Rewards where we reasonably believe the Member has:

— provided false, misleading or incomplete information;

— shared, sold or transferred a Member Account, Reward, Points or the Hospital Staff Discount;

— manipulated transactions or Prize Draw entries to obtain Points, Rewards or prizes not genuinely earned;

— used the Program for a commercial or resale purpose;

— behaved abusively or unlawfully towards Plume team members or other customers; or

— otherwise breached these Terms in a material way.

14.2 Where practicable, Plume will tell the Member of the suspension or closure and the reason for it, and will give the Member a reasonable opportunity to respond under clause 21 before the decision is made final.

14.3 Where a Member Account is closed for a reason other than misuse, the Member has at least 30 days to redeem Rewards available at the time of closure.

15. Changes to the Program and these Terms

15.1 Plume may change these Terms, the Program structure, earn rates, Membership Levels, Rewards, the Hospital Staff Discount and the list of Participating Stores, for reasons including changes in cost, supplier or site arrangements, changes in law, platform capability and improvements to the Program.

15.2 Where a change is not adverse to Members — for example, adding a store, adding a benefit or correcting an error — it may take effect immediately on publication at plumecafe.com.au/perks.

15.3 Where a change reduces a benefit, removes a benefit, increases a Member’s obligations, or otherwise materially disadvantages Members, Plume will give at least 30 days’ notice before it takes effect. Notice will be given by at least two of: email to the registered address; app notification; notice at Participating Stores; and publication at plumecafe.com.au/perks.

15.4 If you do not accept a change, you may close your Member Account under clause 16 at any time before it takes effect. Continuing to use the Program after the change takes effect means you accept the change.

15.5 A change will not remove Points already accrued or Rewards already issued and still within their validity period, except where clause 9 or clause 14 applies.

16. Ending your membership or the Program

16.1 You may close your Member Account at any time through the app, or by contacting us under clause 23. On closure, unredeemed Points and Rewards are forfeited.

16.2 Plume may end the Program, in whole or in part. We will give at least 60 days’ notice before the Program ends, and Members will have at least 30 days from the notice to redeem available Rewards. Points not redeemed by the end date are forfeited.

16.3 If a Participating Store closes or ceases to be operated by Plume, the Program continues at the remaining Participating Stores and Schedule 1 is updated accordingly.

17. Privacy and your personal information

17.1 Plume handles personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Plume privacy policy.

17.2 To operate the Program we collect: your name, contact details, date of birth, transaction and purchase history, Points and Reward activity, store and site of purchase, app and device usage information and Prize Draw entries.

17.3 We use this information to administer the Program, verify eligibility for the Hospital Staff Discount, issue and manage Rewards and Surprise Drops, conduct Prize Draws, prevent and investigate misuse, report on Program performance in aggregate, improve our products and stores, and send communications you have agreed to receive.

17.4 We may disclose personal information to service providers who help us operate the Program, including our loyalty and point-of-sale platform providers, app developers, email and messaging providers and analytics providers. These providers are bound to use the information only for the purposes for which we supply it. Where any provider stores information outside Australia, this is set out in the privacy policy.

17.5 We do not disclose individual Member information, purchase history or Hospital Staff Discount registration details to any hospital, health service, local health district, university or site operator. Reporting provided to a site operator is aggregated and de-identified.

17.6 Plume and LifeGrain are operated by the same group. Personal information collected through the Plume Loyalty Club is not used to create or populate a LifeGrain Loyalty Club membership without your consent.

17.7 Parts of the Program are automated. Membership Level allocation, Reward and Surprise Drop eligibility, offer targeting and inactivity processing are carried out by the Program Platform using your Points balance, purchase frequency, recency and store activity, without individual human assessment. These decisions affect Program benefits only. Information about our use of automated decision-making is set out in the Plume privacy policy.

17.8 You may request access to, or correction of, the personal information we hold about you by contacting us under clause 23. You may complain about our handling of your personal information under clause 21, and you may also complain to the Office of the Australian Information Commissioner at oaic.gov.au.

18. Marketing communications

18.1 By joining the Program you agree to receive Program communications, including Reward notifications, level updates, verification notices, Prize Draw notifications and changes to these Terms. These are necessary to operate your membership and cannot be switched off while your Member Account is open.

18.2 Marketing communications — including promotional emails, app messages and SMS — are sent in accordance with the Spam Act 2003 (Cth). Every marketing message includes an unsubscribe facility, and you may change your marketing preferences at any time in the app or by contacting us.

18.3 Unsubscribing from marketing does not close your Member Account and does not affect your Points, Rewards or Hospital Staff Discount. It may, however, mean you do not receive Surprise Drops or Prize Draw invitations that are sent through marketing channels.

19. Australian Consumer Law and liability

19.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

19.2 To the extent permitted by law, and subject to clause 19.1, Plume is not liable for indirect or consequential loss arising from the Program, and our liability in connection with the Program is limited to resupplying the relevant Reward or benefit, or the value of the relevant transaction, whichever is the greater.

19.3 Plume is not liable for loss caused by a Member’s failure to keep contact details current, to keep account credentials secure, to identify a Member Account before payment, or to redeem a Reward within its validity period.

19.4 Nothing in these Terms affects your rights in relation to the quality, safety or fitness of the food and beverages we sell.

20. Tax

20.1 Members are responsible for any tax consequences arising from participation in the Program, including from receiving a prize. Where a Member receives Program benefits in connection with their employment, the Member should seek their own advice. Plume does not provide tax advice.

21. Complaints, disputes and review

21.1 If you are unhappy with a Program decision — including a declined registration, a suspended discount, a Points adjustment, a Prize Draw outcome or an account closure — contact us under clause 23 with your Member details and what you would like us to do.

21.2 We will acknowledge your complaint within [2] business days and aim to resolve it within [10] business days. A complaint about a decision made automatically by the Program Platform will be reviewed by a person with authority to change the decision.

21.3 Nothing in this clause limits your right to complain to NSW Fair Trading, the Australian Competition and Consumer Commission, Liquor & Gaming NSW in relation to a Prize Draw, or the Office of the Australian Information Commissioner.

22. General

22.1 These Terms are governed by the laws of New South Wales, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

22.2 If any part of these Terms is unenforceable, that part is severed and the remainder continues to apply.

22.3 A failure or delay by Plume in exercising a right under these Terms is not a waiver of that right.

22.4 Plume may assign or novate its rights and obligations under these Terms to a related body corporate or to a purchaser of the business, without affecting accrued Points or issued Rewards. Members may not assign their rights.

22.5 The Program is offered in Australia only and is void where prohibited by law.
